Procédure d’exportation

I-INTRODUCTION

The  Basel Conventione on the Control of Transboundary Movements of Hazardous Wastes and their Disposal is an international treaty (adopted in 1989) that was signed by Côte d’Ivoire in June 1994
This Convention was meant to reduce the flow of hazardous waste between countries.

For the purposes of the Basel Convention and the regulations in Côte d’Ivoire, “waste” means substances or objects that are disposed of, intended to be disposed of or are required to be disposed of under the provisions of national law (Art. 2, §1).

The Convention also aims to minimise the amount and toxicity of waste generated, and to assist developing countries to reasonably manage the waste they produce, whether harmful or not..
In response to the Convention, Côte d’Ivoire has issued the following orders :

 The General Directorate for the Environment and Sustainable Development of the Ministry of Health, the Environment and Sustainable Development  is the competent authority for the implementation of the Basel Convention in Côte d’Ivoire.
Prior to any export transaction, the economic operator must complete the Notification and Movement Documents for Transfrontier Waste Transfers and compile a file that will be examined by the National Committee for the Analysis of Transboundary Waste Movements in order to obtain an Export Authorisation.

II-AUTHORIZATION TO EXPORT

Any natural or legal person wishing to import, export or transfer hazardous waste must first complete a Notification and Transboundary Movement of Waste document and then compile a file before applying for a Waste Transfer Authorisation addressed to the Minister of the Environment and Sustainable Development who will forward it to the National Committee for the Analysis of Transboundary Movements of Waste Files for approval.
Examination of the file in Côte d’Ivoire is free of charge.

III-DOCUMENTATION TO COMPLETE

The notification documents and transboundary movements of wastets can also be downloaded from the website of Basel Convention  or are physically available in the offices of the Department of Industrial Waste and Chemical Substances (DDISC) at Riviera 3 not far from the Lycée Français.
The DDISC also houses the focal point of the Basel Convention. It can be attached to the following emails:  envsec@gmail.com  or gnamessou2005@yahoo.fr.
This documentation is to be completed and must accompany the Authorization application file.

  1. List of documents to be provided for an application for a Hazardous Waste Transfer Authorization
  • A letter requesting authorization addressed to the Minister of Health, Environment and Sustainable Development ;
  • Information relating to the Company, in particular:
  • The Company’s Articles of Association.
  • A copy of the Commercial Register with the nature of the activity as subject.
  • The CNPS certificate (National Social Security Fund).
  • The Tax Certificate (Fiscal Declaration of Existence – DFE).
  • Photocopy and original of the National Identity Card or Identity Certificate or Passport of the person(s) responsible for the Company.
  • Photo ID of the person(s) in charge of the company.
  • Criminal record dated within three (3) months of the Company’s manager(s).
  • The Geographical Location of the Company.
  • The Company’s Certificate of Insurance.
  • Prior waste identification form.
  • Safety measures during transport.
  • Description of containment, storage and transfer processes.
  • The Transport Route.
  • The Financial Guarantee.
  • The Contract linking the requesting company to the recipient of the waste (in the event of export) or the Company of origin of the waste (in the event of import).

The file is to be submitted to the offices of the General Directorate of the Environment or to the Mail Service of the Ministry in charge of the Environment.

  1. Obtaining the Hazardous Waste Transfer Authorization

The dossier is submitted to a National Committee for the Analysis of Transboundary Movement of Waste Dossiers which meets approximately four (4) times a year – See Order N°0011 MINSEDD/DGE/PFCB of 15 march 2012The National Committee is composed of the following structures :

  • Ministry of the Environment (DDISC, CIAPOL, Department of Legal Affairs and Litigation, Basel Convention Focal Point).
  • Ministry of Industry and Mines.
  • Directorate General of Maritime Affairs.

Autonomous Port of Abidjan.

Autonomous Port of San Pedro.

  • General Directorate of Customs

 

The Economic Operator is informed by the office of the Directorate General for the Environment of the decision of the National Committee.
The Operator must then provide the Approval to the Importer for approval in the country of destination.

  1. Export Certificate and Exchange Commitment: GUCE procedure

To be noted in advance
Beyond a value exceeding ten (10) million CFA francs, exports to countries outside the WAEMU are subject to domiciliation with an approved intermediary – See. Art.13, WAEMU Regulation 09/2010.CM.
The Exporter is then required to establish an Exchange Commitment and an Export Certificate.
These documents are required to validate the Customs Export Declaration.
The Export Certificate – See. Example AE – and the Exchange Commitment – See. Example EA – are established online via the Transactional Site of the Single Window for Foreign Trade  Access to the site requires prior registration as an importer, exporter or freight forwarder.
The information to be provided is as follows::

  • Exporter Code (or Occasional Exporter Code).
  • Name and address of the Declarant.
  • Information appearing on the invoice (name of the receiver, HS code of the goods, quantity, amount invoiced, etc.).
  • Name of the bank (in Côte d’Ivoire) involved in the transaction.
  • The invoice.
  1. Customs Declaration

List of documents to be given to the forwarder to make the Customs Export Declaration:

  • Exporter Code.
  • Original Invoice.
  •  Export Certificate (GUCE) (can be done by the forwarder).
  •  Exchange Undertaking (GUCE) (can be done by the freight forwarder)).
  •  Certificate of Origin (EUR1 or WAEMU/ECOWAS or Formule A if required – [See.   Chambre of Commerce Procedure].
  • The copy of the Authorisation for the Transfer of Hazardous Waste signed by the National Committee.
