Procédure d’exportation

I-INTRODUCTION

Exports of medicines are controlled by the Ministry of Health and Public Hygiene  through the Directorate of Pharmacy, Medicines and Laboratories (DPML) – See. Order N°2015-166 OF 28 September 2015 – on the organisation and allocation of the DPML.
The export of medicines is subject to an Export Authorisation from the Ministry of Health and Public Hygiene. This authorisation is issued by the Directorate of Pharmacy, Medicines and Laboratories.

II- AUTHORIZATION TO EXPORT

Only health professionals and approved companies are allowed to export medicines and on condition of obtaining an Export Authorisation issued by the Ministry of Health.
This Export Authorisation is mandatory and is due at the time of the Customs Declaration.
Health professionals and companies eligible for approval:

  • Pharmaceutical Laboratories.
  • Pharmaceutical Representation and Promotion Agencies – See. Approval form: crea_agen_repr_prod_pham_phar.pdf.
  • Wholesaler-Distributors – See Approval form:  créa_gros_repart_phar.pdf.
  • Industrial companies.
  • Wholesale Marketing Companies for Medical and Surgical Equipment and Laboratory Reagents – See. Approval form: crea_ste_com_mat_medi_chir_phar-1.pdf.
  • Wholesale Chemical Marketing Companies.
  • Optics and eyewear companies.
  • Pharmacies.
  • Clinics.
  • Hospitals.
  • Research Organizations.
  • Medical Organizations.
  • Charitable organisations.
  • Local authorities.
  • Development Partners.

The procedures for applying for an Approval, as well as the lists of documents required, are available on the DPMLsite – Ministry of Health and Public Hygiene of Côte d’Ivoire.
Furthermore, it is reminded that the import or export of any goods whatsoever requires the prior obtaining of an importer/exporter code (professional or occasional) – See. Legal regimes for imports and exports .

The exporter must go to the Direction de la Pharmacie, du Médicament et des Laboratoires (DPML) of the Ministry of Health and Public Hygiene with the Pro-forma invoice and its Health Professional Accreditation to obtain an Export Authorisation. The Export Authorisation is issued within 48 hours after submission of the application.

  1. Export Certificate and Exchange Commitment

In case of export by air, sea or land freight

Beyond a value exceeding ten (10) million CFA francs, exports to countries outside the WAEMU are subject to domiciliation with an approved intermediary – See. Art. 13, WAEMU Regulation 09/2010/CM. The exporter is then required to establish an Exchange Commitment and an Export Certificate.
These documents are required to validate the Customs Export Declaration.

The Export Certificate – See. Example AE– and the Exchange Commitment – See. Example EC – are established online, via the transactional site of the  Single Window for Foreign Trade (GUCE).Access to the site requires prior registration as an importer, exporter or forwarder. The information to be provided is as follows :

  • Exporter Code (or Occasional Exporter Code).
  • Name and address of Declarant.
  • Information on the invoice (name of the receiver, HS code of the goods, quantity, amount invoiced …).
  • Name of the bank (in Côte d’Ivoire) involved in the transaction.
  • The Invoice.
  1. Customs declaration

List of documents to be submitted to the freight forwarder for the Customs Export Declaration:

  • The Exporter Code.
  • The Original Invoice.
  • Export Authorisation from the Ministry of Health and Public Hygiene.
  • Approval from the Ministry of Health.
  • Export Certificate (GUCE) (can be done by the freight forwarder).
  • Exchange Commitment (GUCE) (can be done by the freight forwarder).
  • The Certificate of Origin (EUR1 or UEMOA/ECOWAS or Form A) if required.
